The IHC will hear the PTA chairman’s appeal on the dismissal order tomorrow.

A division bench, consisting of Justice Muhammad Asif and Justice Inam Amin Minhas, would oversee the hearing, as per sources.

The PTA Chairman has petitioned the court to invalidate the single bench’s decision and to stay its order until the final ruling on the appeal.

The Islamabad High Court (IHC) has ordered the immediate dismissal of Major General (R) Hafeez-ur-Rehman from his position as Chairman of the Pakistan Telecommunication Authority (PTA), deeming his appointment unlawful.

Justice Babar Sattar delivered the ruling and released an extensive 99-page judgment.

The court determined that the procedure resulting in Hafeez-ur-Rehman’s nomination as Member (Administration) and subsequently as Chairman of the PTA was unconstitutional and illegitimate, characterizing it as a product of legal malice.

The IHC determined that the establishment of the member administration position and the modification of its qualifications to suit Hafeez-ur-Rehman constituted a malfeasance of authority.

The court mandated that Major General (R) Hafeez-ur-Rehman must promptly vacate his position and refrain from occupying any office inside the PTA.

The court mandated that the highest-ranking member of the PTA shall temporarily fulfill the duties of chairman until the federal government installs a new chairman via a lawful and open procedure.

The position of Member (Administration) was established in 2023, subsequent to revisions of PTA regulations that expanded the membership from three to four.
