The appeal
The incumbent Pakistan Muslim League-Nawaz (PML-N) had appealed the Supreme Court’s order allowing PTI to claim reserved seats with a review petition.
In a review petition, the PML-N asked the Supreme Court to revoke its ruling on July 12.
The PTI was not even a party to the case, according to the PML-N, since the Sunni Ittehad Council (SIC) was the one who filed the Supreme Court petition.
According to the PML-N plea, the SC’s decision to grant PTI reserved seats based on SIC plea amounts to a legal transgression.
The Election Commission of Pakistan (ECP) and the SIC were named as respondents by the PML-N in their petition.
A 13-member panel of the Supreme Court, led by Chief Justice Qazi Faez Isa, decided last week that the PTI is entitled to reserved seats. This decision dealt a serious blow to the coalition led by Prime Minister Shehbaz Sharif.
The Peshawar High Court (PHC) decree, which had backed the Election Commission of Pakistan’s (ECP) decision to deny the SIC the reserved seats, was overturned by an 8-5 majority verdict given by Justice Mansoor Ali Shah.
The majority ruling was opposed by Justice Jamal Mandokhail, Justice Ameenuddin Khan, Justice Naeem Afghan, Justice Yahya Afridi, and Chief Justice of Pakistan (CJP) Qazi Faez Isa.
