A physical remand of eight days at IHC is being challenged by PTI MNAs.

The petitioners alleged that they were unlawfully arrested from the premises of the National Assembly without any justification and taken to an unknown location. Based on the details, the petitioners stated that they were elected members of the Senate.

Their eight-day physical remand was eventually authorized by the court. Article 4 and Article 10-A of the Constitution are allegedly violated by the remand order, according to the petitioners. In addition, they argued that the FIR does not define their role in the accused offense, and that there was no report of anyone being harmed during the purported incident involving firing.

IHC was sought by the petitioners to declare the physical remand order that was granted by ATC to be unlawful and in violation of the Constitution.

Several members of the National Assembly of the Pakistan Tehreek-e-Insaf (PTI), including the party chairman Barrister Gohar, were taken into custody by the police in Islamabad after receiving prior authorization from the Speaker of the National Assembly, Ayaz Sadiq.

The arrests of Shoaib Shaheen, Sher Afzal Marwat, and Barrister Gohar, Chairman of the PTI, took place on Monday. MNAs Zain Qureshi and Sheikh Waqas Akram were taken into custody by security personnel from within the Parliament House by the Capital police.

In addition, the police detained Sahibzada Hamid Raza of the Sunni Ittehad Council, Yousaf Khan, Maulana Naseem Shah, and Ahmed Shah Khattak. Owais Ahmed Chatha and Syed Shah Ahmed were also taken into custody.

According to sources, Speaker NA Ayaz Sadiq authorized the arrest of members of the Pakistan Tehreek-e-Insaf (PTI) outside the precincts of the house. A copy of the FIR that had been filed against the PTI MPs for breaking standard operating procedures during the public gathering that took place on September 8 was submitted by the police.

Further, three complaints have been filed in Islamabad under the Peaceful Assembly and Public Order Bill, citing violations of the event’s NOC. These cases have been lodged. Barrister Gohar Ali, Sher Afzal Marwat, Shoaib Shaheen, Omar Gul, Zartaj Gul, Aamir Mughal, Seemabia Tahir, and Raja Basharat are among the 28 individuals named in the FIR. Other individuals implicated in the case include Shoaib Shaheen.

Following a seven-hour absence that was caused by a crackdown against Pakistan Tehreek-e-Insaf (PTI) officials, the Chief Minister of Khyber Pakhtunkhwa arrived at the KP CM House without incident earlier.
