Government and Fazl concur on the Constitutional Court and other changes.
According to sources, Maulana Fazlur Rehman’s demands led to numerous changes being made to the original draft of the constitutional amendment. “With the efforts made by Bilawal Bhutto Zardari, the government side and JUI-F chief have agreed on a minimum agenda over scores of points,” insiders said.
“The JUI-F head requested the withdrawal of the amendments pertaining to the military court found in Articles 51 and 200,” according to sources. “It has also been withdrawn, the proposed clause raising the age limit for judges to 68 years old.”
“The establishment of the constitutional court has been agreed upon by the government and Fazlur Rehman,” according to sources. “The Chief Justice of the Constitution will be a retired Supreme Court justice.”
According to insiders, “the President will appoint the head of the constitutional court initially, on the Prime Minister’s recommendation.” According to sources, “the remaining judges of the court will be appointed from the five high courts on the basis of eligibility.”
According to sources, the court will hear cases involving constitutional issues and will have five to seven judges on it.
According to sources, Maulana Fazlur Rehman and the administration have also decided to alter Article 63-A, and the vote from those who crossed the floor will also be tallied.
According to further reports, a parliamentary committee would select the Chief Justice of the Supreme Court, with a panel of five judges to be called upon for the nomination.
The parties also agreed not to propose a modification regarding the high court judges’ rotation.
The only people who have seen the draft of the proposed 26th amendment to the constitution are Maulana Fazlur Rehman and Bilawal Bhutto. It has been determined that there will be no rush to pass the 26th Amendment.
The proposed constitutional amendment will not include those parts of the Act that have generated dispute. According to the sources, “a constitutional draft comprising agreed-upon parts of legislation will be prepared by the next week.”
