SC gives the Additional Registrar a show-cause notice about case scheduling.
In response to Additional Registrar Nazar Abbas’ failure to schedule a case pertaining to bench powers, Supreme Court Justice Mansoor Ali Shah sent him a show-cause notice and an in-person summons.
A three-member bench led by Justice Mansoor Ali Shah heard the case, which dealt with both ordinary bench powers and constitutional issues.
Despite the court’s directives to set the case for today (Monday), Barrister Salahuddin, who was representing one of the parties, came before the court and stated that he had come from Karachi specifically for this matter. However, the cause list had not been released.
Judge Mansoor Ali Shah said the court was not aware of the situation and ordered the Additional Registrar to be called right away to explain the hold-up.
Zulfiqar Ahmed, the Deputy Registrar, attended the court and gave an explanation of the Additional Registrar’s leave due to illness. Why the court’s order to schedule the matter was not implemented was questioned by Justice Shah.
“The Judges Committee decided to schedule the case related to amendments on January 27 before the constitutional bench,” the Deputy Registrar retorted. As a committee member, Justice Shah expressed surprise at the decision, saying he was not aware of it.
Noting that tax cases were initially scheduled, Justice Ayesha Malik asked why the week’s cause list was altered and questioned how an administrative committee could disregard a court order.
The Judges Committee’s ruling and meeting minutes had to be submitted, and the court also required any written directions about the cause list modifications.
The court sent a show-cause letter to the Additional Registrar, requesting an explanation for the case’s non-scheduled status. After the hearing was postponed until Tuesday, the Additional Registrar was called in person to attend.
