The 26th Constitutional Amendment has been challenged at the Supreme Court.

In the constitutional petition, the petitioner has named the federal government as a respondent, requesting that the court rule that the amendment is invalid.

“With a two-thirds majority, the Parliament could enact laws and amend the constitution, but it could not interfere in judicial affairs,” the petition stated.

It made the case that the 26th Amendment violated both the distribution of powers among state institutions and the fundamental framework of the constitution.

The plea claims that “the amendment has handed over the appointment of the Chief Justice to the incumbent government.” The petitioner claimed that the new amendment also changed the Judicial Commission’s structure.

The petitioner has asked the court to rule that the 26th amendment to the constitution violates both the independence of the judiciary and fundamental rights.

High Court of Sindh

The Sindh High Court has also heard challenges against the 26th Amendment to the Constitution.

An advocate for Illahi Bux has petitioned the supreme court to overturn the constitutional legislation.

The petitioner has asked for the constitutional amendment’s sections 8, 11, and 14 to be deemed void.

Respondents in the plea include the secretaries of the cabinet division, law and justice, and other relevant departments.
