The request for the disqualification of Imran Khan in the Tyrian White case has been dismissed by the IHC.
The Islamabad High Court has rejected a petition for the removal of PTI Founder Imran Khan from his position due to the Tyrian White scandal.
A fresh panel of three judges, led by Justice Tariq Mahmood Jahangiri, presided over the disqualification case of Imran Khan at the Islamabad High Court. The case revolves around allegations that Khan failed to disclose his daughter, Tyrian Jade White, in his nomination papers for the 2018 general elections.
The bench consisted of Justice Arbab Mohammad Tahir and Justice Saman Rafat Imtiaz. The arguments were delivered by Naeem Panjotha, Khan’s counsel.
At the commencement of the hearing, the legal representative of the petitioner, Hamid Ali Shah, stated that Salman Akram Raja had requested a prolongation of the proceedings. Panjotha contended that the issue had already been resolved, and the verdict was subsequently uploaded to the internet. Following the removal of the decision from the website, the bench was recreated via a press release.
Justice Jahangiri inquired whether Panjotha was the legal representative in this particular matter. The individual in question stated that he was acting as the representative legal counsel.
The court stated that Justice Mohsin Akhtar Kayani and Justice Arbab Muhammad Tahir provided their perspective on this case. Advocate Shah stated that there was a dissenting opinion from two justices in this case, which was not endorsed by the chief justice.
Justice Jahangiri stated that two members of the bench expressed the opinion that the application should not be considered, but it was ultimately rejected. Chief Justice Aamir Farooq has voluntarily disqualified himself from the bench.
Shah requested a specific date on which he could provide assistance for the matter. Justice Jahangiri inquired about the possibility of granting relief on a previously dismissed application. According to him, two judges rendered their ruling, which was revealed today in front of everyone from a sealed package.
The court has declared that the case to disqualify the founder of the PTI has already been dismissed by the bench and the majority ruling has been announced. The application has been deemed inadmissible by two judges.
