The Supreme Court bench has sent the case concerning the 26th Amendment to the constitutional bench.
A three-judge panel led by Justice Mansoor Shah was adjudicating the case.
Justice Mansoor Ali Shah stated, “This case presents a constitutional question, and following the enactment of the 26th Constitutional Amendment, constitutional benches will adjudicate matters pertaining to constitutional inquiries.”
“These benches will be established and will resolve the matter; we are submitting these petitions to constitutional benches,” Justice Shah further stated.
Seven dismissed employees of the Ministry of Petroleum and Natural Resources contested the high court’s ruling in the Supreme Court.
The Sindh High Court (SHC) has postponed the hearing of a lawsuit challenging the election of the Mayor of Karachi.
The counsel argued that the case, following the passage of the constitutional amendment, is subject to consideration by a constitutional bench.
The top justice of the high court remarked, “It would be prudent to postpone the hearing.”
The AAG Sindh stated that the bench may continue to hear the case until the Sindh Assembly adopts a resolution to that effect.
